Role Summary: Claims management is an integral part of successful project and contract management and embraces taking a proactive approach in the pursuance, avoidance, mitigation and resolution of claims for and against GE Power to maximize operational and financial performance whilst reducing commercial and financial risks.
Essential Responsibilities: • Collaborate with the project stakeholders to assess and determine entitlement, cause and effect and responsibilities for any alleged claims for additional costs and extension of time, and to enforce, preserve or otherwise defend GE Power’s rights and entitlements in relation to any claims for or against any other parties, including customers, partners, vendors and where appropriate Project insurers as well as GE Power as the case may be; • Prepare reports, draft correspondences and present claim analysis, findings and/or opinions and develop claims resolution strategies in respect of schedule delay, productivity, labor and material escalation, design issues, and contract interpretation for use in negotiations with customers, consortium partners, contractors and vendors; • conduct as necessary and required, re-measurement activities at project site to obtain data and ascertain accuracy and quantities of work in progress and completed for claims purposes; • Participate in Contract closeout and settlement negotiation meetings; • Prepare, coordinate, issue and administer claims for additional costs and time extensions and to analyze and report various attributes such as, progress, contract variations, claim status and contractor performance, cost and schedule exposures taking into consideration the following requirements for the recovery and/or pursuance of additional costs and extension of time: o Analysis of contractual terms and conditions, contract pricing, rates and productivity levels; o Inspection of records and contractual notices, actual time spent, costs incurred, actual productivity achieved, escalation costs resulting from increased labor wage rates and bills of quantities, etc; o Preparation of a cause and effect detailed analysis and critical path using accepted techniques; o Identification of contractual remedies for the recovery of cost and time; and o Compare and analyze base-line schedules against an executed schedule to determine the accuracy of the claim and any delay impact upon the schedule and making recommendation as to the allocation of fault and responsibility of the parties for the additional cost and delay. • Manage assigned claims across multiple regions and jurisdictions, as well as setting the case strategy for these claims in partnership with the project stakeholders including Contract Managers and legal counsels; • Coordinate and manage communication with internal and external project stakeholders (e.g., insurers, loss adjusters and brokers, subcontractors and suppliers, etc.) and ensure that all measures are taken to achieve the best outcome for GE Power; • pursue claims against and robustly defend and rebut claims from customers, vendors, external project partners and other parties to preserve GE Power’s contractual entitlements and to assist Project teams to negotiate the best possible commercial settlements thereby avoiding costly disputes; • Ensure that all correspondences related to any claim is correctly handled, dealt with and responded to in accordance with the requirements of the Project contract; • Ensure that proper records (letters, minutes of meeting etc.) related to any claim are correctly filed and maintained throughout the lifetime of the project contract and in observance of any document retention obligations expressed in the relevant contract, subcontract or agreement and/or in accordance with any document retention policies of GE; • Ensure that regular Project and commercial meetings with the customer, partners and vendors shall be held to review progress of claim and where required to settle claims; and • Ensure that all oral agreements reached with the customer, partners and/or vendors shall be followed by a written confirmation of the agreement details no later than one Operating day or as soon as practicable from the date of such agreement. Formal agreements/change orders shall then be concluded accordingly.
Qualifications/Requirements: • Bachelor's degree in Quantity Surveying, Engineering, Construction Management, or related field from an accredited university. • at least ten (10) years of experience in evaluating construction claims or equivalent litigation support preferably in the Power. Energy or Oil and Gas industry. • Demonstrated knowledge and experience relating to delay analysis techniques and methodologies, calculating and analyzing productivity losses, ability to interpret construction contracts, drawings and specifications. • Demonstrated experience organizing a demanding workload with the ability to work under pressure handling multiple tasks in a tight timeframe. • Demonstrated analytical and problem-solving skills. • Excellent organizational, interpersonal skills, oral and written communication and presentation in English and to produce professional, high quality written claims, presentations or advice in a construction environment relating to additional time and money. • Proficiency in Microsoft Office, project management software, Primavera P6 and/or other equivalent industry related software. • Demonstrated ability in successful development and negotiation of complex contractual claim submissions on international Projects. • Ability to work independently and communicate effectively within and across all levels of project functional groups with diverse nationalities.
